Welcome to Insane Thumbnails (the “Service”), operated by Kammoun Chekir Partners SARL, a company registered in Tunisia (“we”, “us”, or “our”).

By accessing or using the Service at insanethumbnails.com and app.insanethumbnails.com, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the Service.

You must be at least 18 years old to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

To access the Service, you must create an account by providing your name, email address, and a secure password. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately at contact@insanethumbnails.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

Insane Thumbnails is an AI-powered platform that helps YouTube creators generate high-performing thumbnails. The Service includes:

• Video analysis — extracting metadata and transcripts from YouTube URLs or uploaded video files.
• Template library — curated, battle-tested thumbnail layouts from high-performing channels.
• AI thumbnail generation — adapting template compositions to match your video content using artificial intelligence.
• Face swapping — replacing faces in templates with your uploaded avatar.
• AI editing — natural-language editing with spatial targeting to refine generated thumbnails.
• Text overlay — canvas-based text editing before export.
• SEO pack — auto-generated titles, descriptions, and hashtags for multiple platforms.

The Service offers a free tier and several paid subscription plans (Hobby, Pro, Business). Paid plans are billed monthly or annually, as selected at the time of purchase.

• Free tier — 3 thumbnail generations (lifetime).
• Paid tiers — include a monthly generation allowance that resets at the start of each billing period.
• Payments are processed securely by our third-party payment providers. We do not store your full payment card details.
• Prices are displayed in USD and may be updated from time to time. Any price change will take effect at the start of your next billing cycle. We will notify you of material price changes in advance.

We offer a 14-day money-back guarantee on all paid subscriptions. If you are not satisfied with the Service, you may request a full refund within 14 days of your initial purchase by contacting us at contact@insanethumbnails.com.

After the 14-day period, subscriptions are non-refundable. You may cancel your subscription at any time, and your access will continue until the end of the current billing period.

Your content. You retain full ownership of all thumbnails generated through the Service using your content (videos, avatars, text). You may use, modify, distribute, and commercialize your generated thumbnails without restriction.

Our content. The Service itself, including its software, design, branding, template library, and underlying AI models, remains the exclusive property of Kammoun Chekir Partners SARL. You may not copy, reverse-engineer, decompile, or create derivative works of any part of the Service.

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, threatening, or that promotes violence or discrimination.
• Infringe upon the intellectual property, privacy, or other rights of third parties.
• Upload content depicting minors, explicit sexual material, or content that violates applicable laws.
• Attempt to gain unauthorized access to the Service, other user accounts, or our infrastructure.
• Use automated scripts, bots, or crawlers to access the Service beyond the scope of the provided API.
• Resell, sublicense, or commercially redistribute access to the Service without our prior written consent.

We reserve the right to remove any content and suspend or terminate any account that violates these terms, at our sole discretion and without prior notice.

The Service uses artificial intelligence to generate thumbnails and related content. You acknowledge that:

• AI-generated outputs may not always be accurate, appropriate, or free of errors.
• You are solely responsible for reviewing and approving any content before publishing or distributing it.
• We do not guarantee that AI-generated content will not resemble existing copyrighted works. You assume responsibility for verifying that your use of generated content does not infringe third-party rights.

We strive to maintain the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes in advance.

To the maximum extent permitted by applicable law, Kammoun Chekir Partners SARL and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total aggregate liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

You agree to indemnify and hold harmless Kammoun Chekir Partners SARL from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

You may delete your account at any time by contacting us at contact@insanethumbnails.com. Upon termination:

• Your subscription, if any, will be cancelled and no further charges will be made.
• Your data, including generated thumbnails, avatars, and projects, will be permanently deleted within 30 days.
• Any active refund eligibility under our 14-day guarantee remains available.

We may also terminate or suspend your account immediately, without prior notice, if you breach these Terms.

We may update these Terms from time to time to reflect changes in our Service or applicable law. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Tunisia. Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of Tunisia.
